The Situation of Gender in the Workplace

The new millennium has not brought much progress for women seeking top leadership roles in the workplace. Although female graduates continue to pour out of colleges and professional schools, the percentages of women running large companies, or serving as managing partners of their law firms, or sitting on corporate boards have barely budged in the past decade.

Why has progress stalled? A recent study suggests the unlikeliest of reasons: the marriage structure of men in the workplace.

A group of researchers from several universities recently published a report on the attitudes and beliefs of employed men, which shows that those with wives who did not work outside the home or who worked part-time were more likely than those with wives who worked to: (1) have an unfavorable view about women in the workplace; (2)think workplaces run less smoothly with more women; (3) view workplaces with female leaders as less desirable; and (4) conside female candidates for promotion to be less qualified than comparable male colleagues.

The researchers also found that the men who exhibited resistance to women’s advancement were “more likely to populate the upper echelons of organizations and thus, occupy more powerful positions.”

Their conclusion? “Marriage structures play an important role in economic life beyond the four walls of the house.” They affect how people view gender roles and how they categorize others. And, as Harvard professor Mahzarin Banaji has documented in her work, using the Implicit Association Test, this can happen even unconsciously.

So even if a male boss explicitly states — and believes — he supports women in leadership, he might still exhibit contradictory behavior or remain oblivious to the obstacles that female colleagues face. Indeed, according to this HBR Research Report from the Center for Work-Life Policy, only 28% of men, compared with 49% of women, see gender bias as still prevalent in the workplace.

I saw this in my own research for Ending the Gauntlet: Removing Barriers to Women’s Success in the Law. Many of the women partners I interviewed described a lack of support and sponsorship from key men in their firms. Several talked to male colleagues who admitted that the success of married women as equity partners invalidated the choices they and their wives had made about how to divide the responsibilities of work and family.

These biases are understandable. It’s natural to seek validation for the choices, and particularly the sacrifices, you have made. But when this expresses itself in attitudes and actions that make it difficult for talented individuals whose choices have been different to advance, it is critical for workplace leaders to intervene.

The Facial Situation of Presidential Candidates

If your citizenship comes with the responsibility – and privilege – of voting, then every few years you face an interesting challenge. Who will you vote for? Whether you choose to support an incumbent, a celebrated war hero, an experienced government official, or a new face on the political scene, psychologists are incredibly curious about the process by which you come to that decision. There is reason to believe that, coming from a thoughtful and prepared voter, your ballot will reflect an objective assessment of candidate qualifications. You may, for example, use the time before an election to analyze debates, weigh social policies, and scrutinize performance records. With a wealth of political information at the tip of your fingers, only careful, deliberative thinking will contribute to your final decision…right?

Recent research in political psychology tells us that conscious deliberation is only part of the story when it comes to the voter-decision process. Information about candidates is further gathered using no mental effort, through processes operating completely outside of our awareness. Visual cues, for example, such as physical appearance, are instrumental in shaping our impressions of political candidates. Consider the case of Richard Nixon, a United States’ presidential hopeful back in September of 1960. Coming off of a hospital visit and sporting a five-o’clock shadow, Nixon participated in the first-ever televised presidential debate against John F. Kennedy, whose recent return from sunny California left him well-rested and tan. There is reason to believe that Nixon’s arguments were superior: radio listeners thought he won the debate. The estimated 70 million TV viewers, however, overwhelmingly preferred Kennedy. Visual information, i.e. Kennedy’s clean-cut confidence versus Nixon’s haggard appearance, is presumed to have influenced the TV viewers, ultimately shaping their global impressions of both candidates (Kraus, 1988).

Fast forward almost fifty years and researchers are just beginning to understand how physical appearance, particularly facial appearance, factors into voter choice. Nixon’s and Kennedy’s facial expression may certainly have evoked emotional reactions from television viewers during that critical debate. Accordingly, research suggests that feelings, like warmth or happiness, in response to a candidate’s facial gestures can influence voters’ attitudes and subsequent decisions (Sullivan & Masters, 1988). Of particular interest to social-cognitive researchers who study person-perception is how the mind translates facial appearance into beliefs about a candidate’s suitability for office. We now know that in the instant we see a person’s face, an array of fast and implicit cognitive processes take place. In that split second, we unconsciously construct ideas about a person’s personality (Bar, Neta & Linz, 2006). We may think a person is kind, strict, or honest, based only on his appearance. As you might imagine, because we make these personality inferences so easily, they can have important implications for a political candidate seeking election. Indeed, early research had found that a candidate’s photograph can communicate a clear image of his “congressional demeanor,” and fitness for office, affecting his voter appeal (Rosenberg, Bohan, McCafferty, & Harris, 1986). But what is it exactly about a politician’s face that influences his popularity? And which trait inferences matter when it comes to our voting decisions?

As most politicians know, people generally favor familiar faces over unfamiliar faces. What they may not be aware of is people also tend to prefer faces that are similar to their own. Such an idea is firmly grounded in evolutionary theory. Our faces tend to be similar to our family members’ faces, and we also generally share genetic material with them. The evolutionary perspective argues that we are fundamentally wired to protect and spread our genes, so it makes sense that we might be biologically-biased to prefer similar faces. Is this preference sufficiently ingrained so that we might actually prefer candidates who resemble us?

Bailenson, Iyengar, Yee, and Collins (in press) used a creative method to test this idea. Building on their previous work (Bailenson, Garland, Iyengar, & Yee, 2006), they examined the influence of facial similarity on voting behavior by actually manipulating the degree of facial similarity between participants and candidates. How? By digitally morphing images of participants’ faces with photographs of current candidates! Essentially, they screened out participants with glasses and facial hair, and used only high-quality photographs. They then used a computer program to morph, or blend, participants’ faces into the faces of real-life United States’ politicians, such as Hillary Clinton. Participants were unaware of the image modifications.

The researchers conducted three experiments in which they showed participants candidate photos that had been morphed with themselves (self-morph) and/or with a random other participant (other-morph). In some cases, these images were of widely-known politicians, like John Edwards or Rudy Giuliani, while other times they were of unfamiliar candidates. Participants rated each candidate on a set of ten positive personality traits (i.e. moral, intelligent, and friendly), reported their party affiliation (Democrat or Republican), and indicated the strength of that affiliation. In the final experiment, participants also saw a brief description of the candidates’ positions on issues like the Iraq War along with their picture.

The intrigue and appeal of these findings are further enhanced by the researchers’ discovery that judgment speed mattered. They found that immediate, first impressions of competence, made after seeing an image for only 100 milliseconds, were superior to deliberative judgments in anticipating the winner of an election (Ballew & Todorov, 2007). This finding seems counterintuitive: how could gut feelings outperform reflective thinking? At the same time, it fits well with one research study focused not on candidate preferences, but on strawberry jam. Wilson and Schooler (1991) asked participants to taste and rate the quality of different jams, and then tested the “accuracy” of these ratings by comparing them with evaluations offered by trained tasting experts. Results showed that when participants were instructed to reflect on why they liked or disliked the jams, they produced ratings that did not corresponded with the experts’ ratings as well as those who simply rated the jams without reflection.

Haidt on “The Righteous Mind”

Jonathan Haidt is a professor in social psychology and author of The Righteous Mind, an examination of the intuitive foundations of morality and its consequences. He has some disgusting stories for you.

Imagine, if you will, a man going to a supermarket, buying a ready-to-cook chicken, taking it home, and having sexual intercourse with it. He then cooks it and eats it.

Or imagine a brother and sister who go on holiday, and end up sleeping together. They feel that it brings them closer, and are very careful with birth control so there’s no absolutely chance of pregnancy.

Don’t worry if you found these stories sick and wrong — most people do. But trying to pin down what exactly is wrong with these stories can be tricky. No one is harmed, the food isn’t wasted, the siblings are happy, yet it’s somehow still wrong. This is “moral dumbfounding’, the strong feeling that something is wrong without clear reasons as to why that is. According to Haidt, this offers a deep insight into human morality, and has profound implications for politics and religion.

Haidt’s studies bear out his message is that for every one of us, however rational we think we are, intuition comes first, and strategic reasoning second. That is, we rationalise our gut instincts, rather than using reason to reach the best conclusion. So, with the chicken story, you’re left scrabbling around for reasons to explain why something is wrong when you just know that it is. For Haidt, this is something that modern thinking has failed to recognise. “In America there was a long period where we were trying to teach kids critical thinking, and you never hear about it anymore because it didn’t work,” says Haidt.

Haidt sees our reasoning mind and intuition as a rider on top of an elephant, with the rider (reason) serving the elephant (intuition). But he doesn’t necessarily see this as a flaw. “You need to learn how to get the rider and elephant to work together properly. Each have their separate skill, and if if you think that the rider is both in charge and deserves to rule, you’re going to find yourself screwing up, and wondering why you keep screwing up. I think maturity and wisdom occur when someone gets good integration between the rider and the elephant — and I picked an elephant rather than a horse because elephants are really big and really smart. If you see a trainer and an elephant working together it’s a beautiful sight.”

Not only do we start with a conclusion and work backwards when making moral judgements, the different moral tenets you use define where you lie on the political spectrum. Broadly, the left makes moral judgements mostly based on harm and fairness, while the right has a broader palette — harm, fairness, loyalty, authority, and sanctity.

So when, for example David Cameron suggests children should be more deferential, Haidt sees this as textbook: “That’s the authority foundation right there. Respect for authority is an offensive idea to people on the left, but it is quite sensible to social conservatives. It’s speaking directly to the elephant. Did he suggest this because he has really long been upset about the decline of authority, or is he maybe doing this to appeal to the more working-class traditionalist voters, those who vote Labour but are socially conservative at heart?”

But isn’t this simply another typical liberal college professor finding yet another way to attack the right? Haidt says that his work into morality has changed his politics, making him less of a liberal, and more of a centrist: “I’ve really become less enamoured of liberalism and more enamoured of conservatism. I think both are important. It’s a yin-yang thing, you need both and if you let either side run things they’re going to screw it up in very predictable ways.”

Our flawed post-hoc reasoning, our cherry-picking of evidence to suit our instincts, makes us poor policy makers, and creates politics that is tribal, confrontational and ill-suited to solving the world’s problems. “Our reasoning is very good as a press agent and lawyer,” says Haidt, “But we’re so biased, no individual can design social policy just using reason. But once you can accept what reasoning is and what it is designed to do, you can start to design groups and institutions that can do a pretty good job of it. When you put people together, you can think of each person as being like a neuron, and if you put us together in the right way then you can get some very good reasoning coming out of it.”

Haidt’s plea is for us to avoid the demonisation of those we see as morally suspect by understanding the way we reach these moral judgements. Like any evolved mechanism, our brain is a hotchpotch of compromises rather than a perfectly designed machine. Our understanding of others starts with understanding ourselves.

“It’s easy to see how flawed and biased and post-hoc everyone else is. If you realise that it’s true about you too, at least you’ll be a little more modest, and if you’re a little more modest then you’ll at least be a little bit more open to the possibility that you might be wrong. There is some wisdom to be found on all sides, because nobody can see the whole problem.”

The Religious Situation of Compassion and Generosity

“Love thy neighbor” is preached from many a pulpit. But new research from the University of California, Berkeley, suggests that the highly religious are less motivated by compassion when helping a stranger than are atheists, agnostics and less religious people.

In three experiments, social scientists found that compassion consistently drove less religious people to be more generous. For highly religious people, however, compassion was largely unrelated to how generous they were, according to the findings which are published in the most recent online issue of the journal Social Psychological and Personality Science.

The results challenge a widespread assumption that acts of generosity and charity are largely driven by feelings of empathy and compassion, researchers said. In the study, the link between compassion and generosity was found to be stronger for those who identified as being non-religious or less religious.

“Overall, we find that for less religious people, the strength of their emotional connection to another person is critical to whether they will help that person or not,” said UC Berkeley social psychologist Robb Willer, a co-author of the study. “The more religious, on the other hand, may ground their generosity less in emotion, and more in other factors such as doctrine, a communal identity, or reputational concerns.”

Compassion is defined in the study as an emotion felt when people see the suffering of others which then motivates them to help, often at a personal risk or cost.

While the study examined the link between religion, compassion and generosity, it did not directly examine the reasons for why highly religious people are less compelled by compassion to help others. However, researchers hypothesize that deeply religious people may be more strongly guided by a sense of moral obligation than their more non-religious counterparts.

“We hypothesized that religion would change how compassion impacts generous behavior,” said study lead author Laura Saslow, who conducted the research as a doctoral student at UC Berkeley.

Saslow, who is now a postdoctoral scholar at UC San Francisco, said she was inspired to examine this question after an altruistic, nonreligious friend lamented that he had only donated to earthquake recovery efforts in Haiti after watching an emotionally stirring video of a woman being saved from the rubble, not because of a logical understanding that help was needed.

“I was interested to find that this experience – an atheist being strongly influenced by his emotions to show generosity to strangers – was replicated in three large, systematic studies,” Saslow said.

In the first experiment, researchers analyzed data from a 2004 national survey of more than 1,300 American adults. Those who agreed with such statements as “When I see someone being taken advantage of, I feel kind of protective towards them” were also more inclined to show generosity in random acts of kindness, such as loaning out belongings and offering a seat on a crowded bus or train, researchers found.

When they looked into how much compassion motivated participants to be charitable in such ways as giving money or food to a homeless person, non-believers and those who rated low in religiosity came out ahead: “These findings indicate that although compassion is associated with pro-sociality among both less religious and more religious individuals, this relationship is particularly robust for less religious individuals,” the study found.

In the second experiment, 101 American adults watched one of two brief videos, a neutral video or a heartrending one, which showed portraits of children afflicted by poverty. Next, they were each given 10 “lab dollars” and directed to give any amount of that money to a stranger. The least religious participants appeared to be motivated by the emotionally charged video to give more of their money to a stranger.

“The compassion-inducing video had a big effect on their generosity,” Willer said. “But it did not significantly change the generosity of more religious participants.”

In the final experiment, more than 200 college students were asked to report how compassionate they felt at that moment. They then played “economic trust games” in which they were given money to share – or not – with a stranger. In one round, they were told that another person playing the game had given a portion of their money to them, and that they were free to reward them by giving back some of the money, which had since doubled in amount.

Those who scored low on the religiosity scale, and high on momentary compassion, were more inclined to share their winnings with strangers than other participants in the study.

“Overall, this research suggests that although less religious people tend to be less trusted in the U.S., when feeling compassionate, they may actually be more inclined to help their fellow citizens than more religious people,” Willer said.

The Economic Situation of the Middle Class

The American middle class has been battered by the loss of well-paying jobs for the 70 percent of the workforce without a college degree and failed by would-be protectors in government and private institutions, said panelists at the 35th Anniversary Forum of the Harvard Institute for Learning in Retirement on Friday.

Former Pennsylvania Gov. Ed Rendell, whose forthcoming book “A Nation of Wusses” criticizes politicians of both parties for failing to act in the country’s best interest, pointed to elected officials and corporate leaders who can’t see beyond the next election or quarterly earnings report.

“Nobody is looking at what happens 15 or 20 years down the road,” he said.  And regardless of political persuasion everyone has a stake in the future: “We can’t have a good economy if middle class income continues to go down.”

Frank Levy, an MIT urban studies and economics professor, outlined how the middle class has suffered declines since the 1970s as a result of trends ranging from globalization to rising tuition costs.

“Roughly speaking, the society, including the government and individuals, has made a lot of promises about payments to make in future that we can no longer make,” he said.

The middle class has been hurt by the failure of policymakers to plan and account for a sharp rise in health care costs and the widespread job losses tied to the housing collapse.

The question, Levy said, is: “How are we going to distribute the losses? How much will be absorbed by lower incomes and how much will be absorbed in the present versus the future?”

New York Times columnist Joe Nocera assigned another aspect of diminished incomes to the zeal corporate leaders since the 1980s have had for downsizing to boost profits, and the shift from pensions to mutual funds for retirees.  Nocera disavowed the conclusion of his 1995 book, “A Piece of the Action,” which painted a rosy picture of transition from a “country full of people who had money in the bank to a country of people who invested in the stock market.”

But as wages flattened with the decline of U.S. manufacturing, he said,  “This shift has turned out to be terrible for the people who have to save for their own retirement.”

It transferred risk from the institution to the individual, putting more pressure on the middle class, said Nocera, whose latest book, “All the Devils Are Here,” is about the hidden history of the financial crisis.

The best way to help middle-income residents in the United States would be to address the housing crisis, Nocera said. “We have no housing policy. Most people’s equity is tied up in their house and the country has not decided what to do with Fannie and Freddie.”

“Is it all the Republicans’ fault?” asked moderator Paul Solman, PBS business and economics correspondent and Harvard M.B.A. ’79, in introducing Rendell, a leading Democrat.

“Yes,” Rendell said, to widespread laughter at the nearly full First Parish church in Cambridge.

Rendell said the best thing that could happen to corporate America would be to get rid of quarterly earnings reports that put shareholders’ returns ahead of visionary and wise business management.

There was agreement among the panelists that U.S. corporations should pay more taxes.

Levy noted that the United States is in the bottom third of corporate taxes paid in the world.

Nocera said that tax reform would free up a lot of corporate money for better purposes.

“You would generate more revenue and make the corporations more efficient because GE wouldn’t have a 1,000-person tax office to find loopholes,” Nocera said. “But the reason it will never happen is this is how Congress lives and dies. They generate their own revenues by saving those loopholes or creating new ones.”

The panelists agreed that skyrocketing tuition is hitting the middle class hardest.

“If you’re poor, you can get grants and the rich pay full price,” said Nocera, using the example of the California public college system that now charges in-state students $30,000. “If you’re middle class you can’t afford it.

“The state of California has taken this jewel and said we’re not going to cut back on our prison system but we’re going to cut back on our university system and balancing its budget on the backs of the middle class.”

Nocera concluded, however, “The middle class is under siege but it’s not quite as hopeless as people like me portray it.”

Some Upsides to Terror Management

Past research suggests that thinking about death is destructive and dangerous, fueling everything from prejudice and greed to violence. Such studies related to terror management theory (TMT), which posits that we uphold certain cultural beliefs to manage our feelings of mortality, have rarely explored the potential benefits of death awareness.

“This tendency for TMT research to primarily deal with negative attitudes and harmful behaviors has become so deeply entrenched in our field that some have recently suggested that death awareness is simply a bleak force of social destruction,” says Kenneth Vail of the University of Missouri, lead author of the new study in the online edition of Personality and Social Psychology Review this month. “There has been very little integrative understanding of how subtle, day-to-day, death awareness might be capable of motivating attitudes and behaviors that can minimize harm to oneself and others, and can promote well-being.”

In constructing a new model for how we think about our own mortality, Vail and colleagues performed an extensive review of recent studies on the topic. They found numerous examples of experiments both in the lab and field that suggest a positive side to natural reminders about mortality.

For example, Vail points to a study by Matthew Gailliot and colleagues in Personality and Social Psychology Bulletin in 2008 that tested how just being physically near a cemetery affects how willing people are to help a stranger. “Researchers hypothesized that if the cultural value of helping was made important to people, then the heightened awareness of death would motivate an increase in helping behaviors,” Vail says.

The researchers observed people who were either passing through a cemetery or were one block away, out of sight of the cemetery. Actors at each location talked near the participants about either the value of helping others or a control topic, and then some moments later, another actor dropped her notebook. The researchers then tested in each condition how many people helped the stranger.

“When the value of helping was made salient, the number of participants who helped the second confederate with her notebook was 40% greater at the cemetery than a block away from the cemetery,” Vail says. “Other field experiments and tightly controlled laboratory experiments have replicated these and similar findings, showing that the awareness of death can motivate increased expressions of tolerance, egalitarianism, compassion, empathy, and pacifism.”

For example, a 2010 study by Immo Fritsche of the University of Leipzig and co-authors revealed how increased death awareness can motivate sustainable behaviors when pro-environmental norms are made salient. And a study by Zachary Rothschild of the University of Kansas and co-workers in 2009 showed how an increased awareness of death can motivate American and Iranian religious fundamentalists to display peaceful compassion toward members of other groups when religious texts make such values more important.

Thinking about death can also promote better health. Recent studies have shown that when reminded of death people may opt for better health choices, such as using more sunscreen, smoking less, or increasing levels of exercise. A 2011 study by D.P. Cooper and co-authors found that death reminders increased intentions to perform breast self-exams when women were exposed to information that linked the behavior to self-empowerment.

One major implication of this body of work, Vail says, is that we should “turn attention and research efforts toward better understanding of how the motivations triggered by death awareness can actually improve people’s lives, rather than how it can cause malady and social strife.” Write the authors: “The dance with death can be a delicate but potentially elegant stride toward living the good life.”

How Much Choice Would You Choose?

Undergraduates packed Science Center E on Monday to hear two of Harvard’s leading social scientists discuss the way that humans make decisions, and whether having more choices really makes us happier.

The event, “What is Your N? A Personality Test for 4 AM Philosophers,” featured a conversation between social psychologist Dan Gilbert and economist N. Gregory Mankiw, and was sponsored by the Harvard University Initiative on the Foundations of Human Behavior. The discussion was moderated by professors Nicholas Christakis of Harvard Medical School and the Department of Sociology and David Laibson of the Department of Economics.

Laibson began the debate with the following thought experiment:

“We have pre-selected 100 different bottles of alcohol, covering all popular categories — beer, wine, rum, gin, vodka, whiskey, etc. Another person (who remains anonymous) is going to take one (regular-sized) drink, poured from one of the 100 bottles. Call him/her the recipient.

You will pick the number of bottles that the recipient will be able to choose among. To give the recipient complete choice, you would pick N = 100. To simplify the recipient’s decision, you would pick N < 100. You can pick any N value from 1 to 100.

If you pick N < 100, a robot will randomly determine which of the original 100 bottles the recipient will receive (with no repeats). You don’t get to pre-select the specific bottles the robot will choose. The N bottles will be presented to the recipient in categories (like whiskeys or vodkas), so the recipient can easily sort through them.

Your job is to pick N so as to maximize the happiness of the recipient.”

Next, Laibson asked the group to choose the number of bottles that they would send to the recipient under two different scenarios. In the first, the recipient would never know that there were 100 bottles to begin with. In the second scenario, he or she would.

As the students tapped on their laptops to submit their responses to the question online, Mankiw and Gilbert had at it. Mankiw kicked off the discussion by saying that the answer was easy for him and, he hoped, for anyone who had taken his introductory economics class. He would send the anonymous stranger all 100 bottles. Without any knowledge of the recipient’s tastes, it made sense to send as many bottles as possible in order to increase the chance that the stranger would get a drink that they would like.

“My wife and I [recently] went to a bar and had a drink and dinner,” he explained. “The bar had a big selection. I had no trouble at all. I said ‘I want a Tanqueray martini on the rocks with a twist.’ If the bartender had said ‘We randomly reduced the number of selections, so we don’t have Tanqueray tonight. We have Bombay Sapphire,’ I would have been a little disappointed. If they had said ‘We only have Gordon’s gin tonight,’ I would have been really upset. And if they had said ‘All we have is Kahlua, and crème de menthe,’ I would have walked out. So it was very clear to me that more selection is good.”

Gilbert said that Mankiw’s answer was not surprising. Americans like choices; the more the better. We want to choose what we want, even if the options are so great that our decision becomes essentially random. But Gilbert said there is more to choice than simply matching selection with preferences, and that there are costs associated with decision making, particularly when the options are too great. To illustrate his point, Gilbert described a study by Princeton psychologist Eldar Shafir.

Shafir presented doctors with a pink pill that was said to treat osteoarthritis. The physicians learned about the drug, and then were asked whether or not they would be likely to prescribe it. Most said that they would.

Shafir then went to another group of physicians, this time with a pink and blue pill. He told the group that both would treat osteoarthritis and that the drugs were similar in their effects, aside from their color. He asked this group of doctors whether they would prescribe the pink pill, the blue pill, or neither. Fewer doctors said that they would give patients a pill — either pink or blue — than the group that had been presented with only one pill.

“You should get at least the same number prescribing one of the pills,” said Gilbert. “Or even more, because some will only like blue pills. However, the actual number goes down. Why? Because the physicians say ‘Well, I could do nothing, or choose between one of these two similar pills and I really can’t decide between them, so I’ll do nothing, because nothing looks really different than the pill.”

In terms of Laibson’s thought exercise, Gilbert noted that more bottles and more types of liquor could make the decision more difficult for the recipient. If you offer the drinker wine or beer, and the drinker likes wine, the choice is easy. But if the drinker likes wine and gets four different bottles to choose from versus one type of beer, they might actually choose the beer, even though they prefer wine.

“Because I’ve given you extra choices, you have now gone to the thing you like less, because you can’t think of a good reason to pick among the wines that are so similar,” Gilbert said.

After some waffling, Gilbert, half seriously, gave the number of bottles he would send to the stranger: two.

“Then you have only Kahlua and crème de menthe!” laughed Mankiw.

After Gilbert and Mankiw held forth, Laibson revealed the results of the online poll. Under conditions where the recipient would not be informed if their choices were narrowed, there was a barbell-shaped distribution. A large group of the 220 student respondents said that they would send between zero and 30 bottles to the drinker, with another group up at 100 bottles. In the second scenario, however, where the recipient would know if the selection had been pared, undergraduates overwhelmingly voted to send all 100 bottles to the drinker.

The results were fascinating to Laibson, who has studied employee participation in retirement plans and discovered that enrollment increases dramatically when workers are automatically enrolled and must voluntarily opt out. Given that the criticism for making auto enrollment the default in business is often that the policy is paternalistic, the results of the survey shed light on when people are OK with “Big Brother” and when they are not.

“The message here seems to be ‘Be a paternalist, but keep it a secret,’” Laibson said, eliciting laughter from the students. “The minute the recipient knows [his or her choices have been narrowed], this community gives a different answer [to the thought experiment]. Paternalism is bad when the recipient understands that paternalistic motives organize what happens to them.”

Low-Effort Cognition and Political Ideology

When people use low-effort thought, they are more likely to endorse conservative ideology, according to psychologist Scott Eidelman of the University of Arkansas. Results of research by Eidelman and colleagues were published online in Personality and Social Psychology Bulletin.

“People endorse conservative ideology more when they have to give a first or fast response,” Eidelman said. “This low-effort thinking seems to favor political conservatism, suggesting that it may be our default ideology. To be clear, we are not saying that conservatives think lightly.”

While ideology – either conservative or liberal – is a product of a variety of influences, including goals, values and personal experiences, Eidelman said, “Our data suggest that when people have no particular goal in mind, their initial cognitive response seems to be conservative.”

Eidelman collaborated with Christian Crandall of the University of Kansas; Jeffrey A. Goodman of University of Wisconsin, Eau Claire; and John C. Blanchar, a University of Arkansas graduate student, on studies reported in “Low-Effort Thought Promotes Political Conservatism.”

The researchers examined the effect of low-effort thought on the expression of ideology in several situations. In a field study, bar patrons were asked their opinions about several social issues before blowing into a Breathalyzer. Whether the individual self-identified as liberal or conservative, higher blood alcohol levels were associated with endorsement of more conservative positions. The results indicated that this was not because the conservatives drank more than the liberals.

The results were not just the alcohol talking: In one lab experiment, some participants were asked to respond quickly to political ideas, while others had ample time to respond. In another, some participants were able to concentrate while responding to political statements, while others were distracted. In both cases, participants with less opportunity to deliberate endorsed conservative ideas more than those who were able to concentrate.

In a fourth study, deliberation was manipulated directly. Some participants gave their “first, immediate response” to political terms, while others gave “a careful, thoughtful response.” Those instructed to think in a cursory manner were more likely to endorse conservative terms, such as authority, tradition and private property, than those who had time to reflect.

The researchers stressed that their results should not be interpreted to suggest that conservatives are not thoughtful.

“Everyone uses low-effort thinking, and this may have ideological consequences,” they write. “Motivational factors are crucial determinants of ideology, aiding or correcting initial responses depending on one’s goals, beliefs and values. Our perspective suggests that these initial and uncorrected responses lean conservative.”

Carol Tavris Interview – Podcast

Carol Tavris describes dissonance theory and how self-justification and self-deception often keep people from changing their minds even in the light of compelling contrary evidence, because the evidence is often dissonant with one’s self-image. She details the implications of dissonance theory for the persistence of psychic charlatans and other peddlers of the paranormal, and how it may explain how someone like Sylvia Brown can live with herself, and also how it may explain how believers remain so gullible about such unsupportable claims. She describes confirmation bias as a component of dissonance theory. She talks about how dissonance theory applies to the skeptic movement, both in terms of suggesting the best strategies for engaging the credulous, and in terms of fostering skepticism about one’s own skeptical views. And she argues that skepticism should be affirmative rather than destructive in its approach, and focused on both critical thinking and creative thinking alike.

Jon Hanson on Law and Mind Sciences

Harvard Law School just published an interview with Jon Hanson.  We’ve posted it in full below.

Director of the Project on Law and Mind Sciences at Harvard Law School (PLMS), Professor Jon Hanson has long combined social psychology, economics, history, and law in his scholarship. After PLMS hosted several conferences featuring leading mind scientists and legal scholars, Hanson collected the work of many of the contributors in a book he edited, “Ideology, Psychology, and Law” (Oxford University Press). [Introductory chapter available, here].

In the following Q&A, he speaks about the new book, the connection between law and mind sciences, and his own work in a field that has grown rapidly over the past 20 years.

What sparked your interest in the study of mind sciences and the law?

My interest has evolved through several stages. Although I studied economics in college, I did so with special interest in health care policy, where the life-and-death decisions have little in common with the consumption choices imagined in neoclassical economics. Purchasing an appendectomy through insurance has little in common with buying a fruit at the market.

After college, I spent a year studying the provision of neonatal intensive care in Britain’s National Health Service, attending weekly rounds with neonatologists at London hospitals, meeting with pediatricians in rural English hospitals, interviewing nurses who were providing daily care for the infants, some of whom were not viable, and speaking with parents about the profound challenges they were confronting. Those experiences strengthened my doubts regarding the real-world relevance of basic economic models for certain types of decisions.

In law school, I studied law and economics, but tended to focus on informational problems and externalities that had been given short shrift by some legal economists at the time. After attending a talk by, and then meeting with, the late Amos Tversky, I became an early fan of the nascent behavioral economics movement.

It wasn’t, however, until I spent a couple of years immersed in cigarette-industry documents in the early and mid 1990s that I felt the need to make a clean break from the law’s implied psychological models and to turn the mind sciences for a more realistic alternative.

What was it about the cigarette documents that had that effect?

Well, they made clear that the tobacco industry articulated two views of their consumers – an inaccurate public portrayal, and a more accurate private view.

The first, which the industry conveyed to their consumers and to lawmakers, was of smokers who are independent, rational, and deliberate. Smokers smoke cigarettes because they choose to, because smoking makes them happier, even considering the risks. The industry thus gave consumers a flattering view of themselves as autonomous, liberated actors while assuring would-be regulators that there was no need to be concerned about the harmful consequences of smoking. Smokers were, after all, just getting what they wanted.

The second view of the consumer, which was evident in the industry’s internal documents, was of consumers as irrational, malleable, and manipulable. The industry’s confidential marketing strategy documents, for instance, made clear that the manufacturers theorized and experimented to discover how to target, persuade, lure, and chemically hook young consumers to take up and maintain the smoking habit. That internal understanding of consumers had nothing in common with the industry’s external portrayals.

I came to the realization that, unfortunately, the latter view of the human animal is far more accurate and, furthermore, that failure to understand the actual forces behind human behavior may be contributing to injustice.

How did that realization influence your research?

In the late 1990s, I put my writing down and devoted a couple of years to learning what I could about the mind sciences – social psychology, social cognition, cognitive neuroscience, and the like. Those fields, coincidentally, were blossoming with new theories, new methodologies, and new findings and insights, most of which created challenges to the fundamental assumptions in law and legal theory.

What were some of those insights?

To keep things simple, I’ll boil them down to two big ones.

First, mind scientists had learned that most people in western cultures operate with a naïve and commonsensical model of human psychology that presumes that an individual’s actions reflect a stable personality or disposition and little else. From that perspective, people are presumed to be in control of, and responsible for, their behavior and its consequences.

By the way, that’s the same model of human behavior that is employed in law and conventional legal theory. And it’s the same model that the tobacco industry actively promoted.

The second big insight was that that model of human behavior is fundamentally wrong. People are moved less by a stable disposition and more by internal and external forces that generally go unnoticed in our causal stories. The errors go beyond our causal assessments of other people’s behavior; we confuse and deceive even ourselves, believing our own reasons, when social science reveals those reasons often turn out to be mere confabulations.

What does that mean for the law?

Exactly. That’s the big question. My briefest answer is: a lot. The book is one place where the contributors and I begin to sketch some of the answers.

Given the large gap between what the law assumes and what the mind sciences have shown to be true, my initial goal has been to understand the breadth and contours of that gap and to develop a better understanding of the psychological and contextual forces behind human behavior. I have resisted the strong urge to focus on only those psychological tendencies that can lead to straightforward but narrow implications for law.

Having said that, abandoning the familiar, if wrong, conception of human behavior is daunting and unsettling; it calls for establishing new knowledge structures and being open to some humbling truths about ourselves and some uncomfortable truths about our justice system.

I expect that several generations of lawmakers, legal academics, and lawyers will be grappling with the implications of what mind scientists are discovering about human behavior. Indeed, they will have to do so, if we are ever going to find meaningful solutions to many of our thorniest policy challenges.

Is this entirely new terrain?

I shouldn’t give the impression that I am alone in the wilderness. The approach I’ve taken has its origins in the legal realism movement, and there is actually significant overlap with parts of more recent legal theoretic schools of thought, from law and economics to critical legal studies.

Furthermore, there are other scholars around the country exploring this terrain, and I have been extraordinarily lucky to work with a number of remarkable students over the years, including Melissa Hart, Doug Kysar, David Yosifon, Adam Benforado, Michael McCann, and Mark Yeboah.  Most of those students have gone on to make their own path-breaking contributions to law and mind sciences.

Can you say more about how the field has evolved and your involvement in it over the last 20 years?

Well, 20 years ago, only a small but important corner of psychology known as “decision theory” or “behavioral economics” was getting much attention among legal theorists. Roughly, the research and evidence in that field disputed the “rationality” assumption of the “rational actor” model. I co-authored several articles arguing that those insights suggested that market actors could, would, and do manipulate the risk perceptions of consumers.

A decade ago, I co-wrote a pair of law-review articles (“The Situation” and “The Situational Character”) introducing some of the broader insights of mind sciences and speculating on some of their implications for law. The articles were among the first of their kind, and contested even the “actor” portion of the “rational actor” model. At the time, many readers from legal academia found the research we reviewed to be foreign and hard to fathom.

Five years ago, I began the Project on Law and Mind Sciences. With then-Dean Kagan’s support, some technical know-how from Michael McCann, and the aid of many outstanding students, I set up a website and blog and began holding annual conferences intended to help bridge the gap between the law and the mind sciences. In the meantime, numerous books have popularized the mind sciences, and several new law school programs and projects have been established around the country reflecting and reinforcing this burgeoning interdisciplinary approach.

As of today, the mind sciences are, well, hot. There is now almost too much scholarship for me to keep up with, judges are beginning to cite such research in their opinions, and student groups are springing up in law schools, including the vibrant Student Association for Law and Mind Sciences (or “SALMS”) at Harvard Law School. Every year, I hear from more 1Ls who tell me they chose Harvard Law School because of the exciting work that we’ve been doing.

Are other members of the HLS faculty now employing mind sciences in their work?

Absolutely. Alan Stone has been writing and teaching about the law and psychiatry since the 1960s.  Cass Sunstein and Christine Jolls, when here, were prominent leaders of the economic behavioralism movement. Several other members of the faculty employ mind sciences in elements of their scholarship and teaching. Lani Guinier, Bob Bordone, Martha Minow, Duncan Kennedy, Charles Ogletree, Bob Mnookin, Larry Lessig, Diana Feldman, Bruce Hay, Yochai Benkler, Glenn Cohen, and David Cope come to mind, and I’m surely forgetting some. Among our visitors this year, Dan Kahan and Martha Chamallas are prominent leaders in this interdisciplinary approach.

Many of us are interacting more often and more collaboratively with mind scientists in other departments of this University and beyond, and I would be surprised if we didn’t add a social psychologist to our faculty in the next decade, as other law schools have.

Your book has more than 20 contributors representing different disciplines. Does their work share a common theme?

First, let me emphasize that the book reflects the work of many students and my assistant, Carol Igoe, who helped organize the conferences on which much of the book is based and who helped in the initial editing stages as part of a seminar that I taught.

To your question, I need to be quite abstract to locate one common theme. If there is a single thread running throughout the book, it is that “how we think” affects “what we think” about law. Many of the contributors – social psychologists, political scientists, legal scholars among them – also consider the effects of “what we want to believe” on “how we think.”

More concretely, some authors examine the implications of the dispositionist conception of the person for the law. Others scrutinize and challenge the ideological premises of prominent legal goals, including utilitarianism and instrumentalism. Some consider the harmful effects of the “free market” ideology. Others look at the implicit motives underlying political ideologies – that is, left and right – while a few summarize evidence regarding the effects of political ideology on judicial decision-making. That’s a sample.

You write that the legal system is built on a dubious ideological framework. How so?

There are several ways in which that is true. Construing “ideology” broadly to refer to shared understandings of human behavior, I’ll answer by echoing what I’ve already highlighted. The legal system presumes that a person’s behavior is the manifestation of little more than a stable set of preferences, combined with a given supply of information, activated by the person’s will. Such perceived truths about what makes people behave as they do shape beliefs about why some groups are advantaged or disadvantaged or about how well certain systems or institutions operate. Unfortunately, those shared understandings are often incorrect.

How do ideology and psychology influence judicial decision making?

That’s another great question, which calls for a bigger answer than I can muster here. What I can say is that there seems to be little disagreement among observers of the legal system that judicial decision making is influenced by ideology. Although some point to Roe v. Wade while others point to Citizens United as their exemplar, the disagreement is over when and how judges are swayed by ideology.

Social psychology and social cognition help us see that there is no escaping the influence of ideology, any more than a person can speak without an accent.  Although we tend to hear the accents and perceive the ideologies of those who don’t share our own, we all have both.  So ideology is inescapable; pretending that we operate outside of ideology probably makes us more, not less, subject to its biasing influence.

More important, mind scientists have discovered some of the implicit motives and situational factors that push us toward one ideology or another, including political ideologies or legal-theoretic ideologies.

Will an awareness of mind sciences help an attorney in practicing the law?

I hope so.

Having an awareness of the power and effects of psychology and ideology on the law, a lawyer can better predict the outcomes of cases and more ably persuade jurors or judges to see a case their way.

An imperfect analogy is to a doctor who understands the underlying causes of a disease and not simply its symptoms. A lawyer who understands what is moving the law is like the doctor who understands the disease and its processes. Such a lawyer can be effective in taking on the tough, novel cases on the frontiers of the law.

Understanding the remarkable insights being generated by mind scientists similarly can help lawyers to understand and work with their clients or even to recognize and articulate injustices that might otherwise be missed.

My own teaching reflects my strong belief that law students will make better lawyers if they learn some psychology. At the very least, they will learn something about themselves.

Looking for the Evil Actor – Reposted

Five years ago Jon Hanson and Michael McCann wrote and published the following post about Joseph Kony as part of a series on the the situational source of evil.  In light of the attention Kony is now getting (see Youtube video, “Kony 2012,” here or at bottom of this post), we thought it might be worth posting again.

In Parts I, II, and III of his recent posts on the Situational Sources of Evil, Phil Zimbardo makes the case that we too readily attribute to an evil person or group what should be, at least in part, attributed to situation. This was a key lesson of Milgram’s obedience experiments as well as Zimbardo’s Stanford Prison Experiment. And that lesson, unfortunately, seems similarly evident in far too many real-world atrocities.

Lords Resistance ArmyThere are numerous reasons, some of which those earlier posts highlighted, why the situationist lesson is an unpopular one. This post suggests another.

Think for a moment about the sort of evil that is so grotesquely apparent right now in The Sudan and Uganda, both of which are in the midst of civil wars–wars that have featured indescribably horrific acts, such as villages ravaged by soldiers who chop off limbs of children. Perhaps most harrowingly, the “evil-doers” are often children themselves, many of whom are kidnapped and then conscripted into bands of mutilating marauders.

Joseph Kony’s Lord Resistance Army, for example, is comprised mainly of abducted children who roam northern Uganda, where “many families have lost a child through abduction, or their village . . . [have been] attacked and destroyed, families burned out and/or killed, and harvests destroyed by . . . . the Lord’s Resistance Army.”

The plight of Ochola John, pictured below, exemplifies an all-too-common story: his hands, lips, nose, and ears were cut off by members of the Lord Resistance Army. It is a difficult image to take in (note, we opted against many other more graphic photos).

Such atrocities have led many in Uganda toOchola John question how children could become evil incarnate:

We don’t understand how Kony could have a child soldier slash a fellow child abductee with a machete or make a group of children bite their agemate with their bare teeth till he bleeds to death.

In searching for answers, some have turned to situationist factors:

It is easy to assume that the person who commits such an atrocity is deranged or even inhuman. Sometimes it is the case. But not always. It is possible for a normal individual to commit an abnormal, sick act just because of the situation s/he finds him/herself in, and the training s/he is exposed to.

How could this happen? Zimbardo’s ten-factor list suggests some of situationist grease that no doubt lubricates the wheels of evil. Kony’s methods and ideology are extreme, to be sure, but they are familiar: saving his country from evil by building a theocracy.

In that way, dispositionism can give way to a weak form of situationism, but only up to a point — a tendency that has elsewhere been called selective situationism or naive situationism. Kony’s evil disposition is the “situation” influencing the impressionable young boys. In the end, we place evil almost exclusively in one or a small number of actors — usually human, but sometimes supernatural. No doubt, Kony is immensely blameworthy, so much so that we, the authors, can scarcely bring ourselves even to suggest that the horrors might have multiple origins, beyond the gruesome actions of the most salient actors involved.

By locating evil ultimately in a person or group, we avoid a disconcerting possibility that there is more to the situation beyond the bad individuals. When evil comes packaged within a few human bodies, it is rendered more tractable, identifiable, and perhaps, in a way, less threatening — very “them,” and very “other.” Such a conception undermines the unsettling possibility that, because of the situation, there may be more “evil actors” behind those that we currently face. Get rid of the bad apples, we imagine, and the rest of the batch will be fine. Perhaps more important, it permits us to ignore the possibility that the barrel may be contaminating. We need not confront any apprehensions that our systems are unjust, the groups we identify with are contributing to or benefitting from that injustice, or that we individually play some causal role in it.

Joseph Kony is said to have abducted 20,000 kids in the last 20Joseph Kony years. But he has done so with minimal resistance from Uganda’s government, and with virtually no intervention from foreign powers.

Is there any line at which we non-salient bystanders of the world, including Americans, begin to bear some share of responsibility for suffering such as that endured by Ochola John? Maybe the answer is “no,” as most of us apparetly presume. But maybe it is “yes,” and maybe that line has already been crossed.

We are not making a foreign policy recommendation here. We are simply highlighting a form of blindness that we suspect influences all policy. That is, dispositionism (and motivated attributions generally) helps us push that line of responsibility toward, if not all the way to, the vanishing point — even if it does little to reduce the atrocities themselves. Dispositionism helps us to see the apple, or perhaps the tree, and to miss the orchard and the liberty-trade-centers-911.jpgforest and, perhaps, ourselves.

There are other examples of that tendency of allowing our attributions toward salient (and often despicable) individuals to eclipse any possibility of a more complex, far-reaching causal story. Our criminal justice system is partially built upon it. Consider, also, the widespread response to Susan Sontag’s infamous New Yorker essay, in which she described the of 9/11 terrorism not as

a “cowardly” attack on “civilization” or “liberty” or “humanity” or “the free world” but an attack on the world’s self-proclaimed super-power, undertaken as a consequence of specific American alliances and actions. . . . And if the word “cowardly” is to be used, it might be more aptly applied to those who kill from beyond the range of retaliation, high in the sky, than to those willing to die themselves in order to kill others. In the matter of courage (a morally neutral virtue): whatever may be said of the perpetrators of Tuesday’s slaughter, they were not cowards.

Regardless of the veracity of Sontag’s claims, many Americans did not want to hear such a non-affirming interpretation in the wake of the terror. She not only implicated American policies but suggested that perhaps the attackers were not as “beneath us” as many had portrayed.

As one of us summarized in another article (with Situationist contributors Adam Benforado and David Yosifon), many conservative commentators responded to Sontag and her claims with predictable rage and disgust (while most moderates and liberals took cover in the safety of silence).

Charles Krauthammer called Sontag “morally obtuse,” while Andrew Sullivan labeled her “deranged.”John Podhoretz claimed that she exemplified the “hate-America crowd,” that out-group of Americans who are “dripping with contempt for the nation’s politics, its leaders, its economic system and for their foolish fellow citizens.” And Rod Dreher really drove home the point saying that he wanted“to walk barefoot on broken glass across the Brooklyn Bridge, up to that despicable woman’s apartment, grab her by the neck, drag her down to ground zero and force her to say that to the firefighters.”

We see ourselves as “just,” and don’t like being “implicated” by clear injustice, a discomfort that is often assuaged by looking for the Evil Actor. But when evil continues, even after the evil individuals have been stopped, perhaps we glimpse one reason why, as George Santayana famously put it, “those who cannot remember the past are condemned to repeat it.”

Nancy Gertner is a former federal judge, the author of a recent memoir (“In Defense of Women”), a professor of practice at Harvard Law School, and an authority on sentencing, jury system discrimination, forensic evidence, and other legal areas.

But go back to June 1971, the month she had a loud argument with her mother in their kitchen in Flushing, Queens, N.Y. Gertner was about to graduate from Yale Law School and assume a prestigious clerkship in Chicago. But her mother wanted her to take the test to be a Triborough Bridge toll taker — just in case.

For a young woman lawyer at the time, “just in case” wasn’t a bad idea. The law was a man’s world. But just a decade later, the culture seemed to swing toward what feminists worked for: parity. By the late 1980s, first-rate law firms were hiring men and women in equal numbers. “We thought the numbers would do everything,” Gertner said during a lunchtime talk on Feb. 23 that was sponsored by the Women and Public Policy Program at the Harvard Kennedy School. (Weekly talks there are part of the program’s mission to create gender equality.)

But faith in the raw numbers turned out to be “dramatically wrong,” said Gertner. “Advancement has stalled.” Half of all new lawyers are women, she said, but only 16 percent of equity partners in law firms are female. And of lawyers who leave the profession, most are women — and most do it because of family and social concerns.

Gertner used the lens of the legal profession to speculate why, after earlier rapid advances, feminism’s cultural agenda seems to have stalled. (Universities, she said, are in an analogous position, with plenty of women graduating as Ph.D.s, but few getting to the top of the academic game.)

During her years on the bench from 1994 to 2011, Gertner got used to being trotted out at events as an example of progress. “You’re supposed to say: ‘Things are fabulous,’ ” she told her audience at the Taubman Building’s Cason Seminar Room. But they are not. The women’s movement was not just about having more choices, she said, but about “revolutionary” changes in the workplace and at home that have not happened yet.

In today’s “imperfectly transformed world,” said Gertner, it is social expectations and an “unfriendly workforce” that mean a woman — if anyone — usually will stay home with the children. (She called this reality “the maternal wall.”)

Gertner cited one study that showed 30 percent of women leaving the law, including 15 percent of equity partners, those with a financial stake in a firm. Another study, she said, showed that 34 percent of female law graduates have worked part time, compared with only 9 percent of their male counterparts.

So without a corresponding transformation of family responsibilities, feminism is likely to stay stalled, she said. “We’ve hit a wall.”

It’s not a situation that discrimination lawsuits can correct, said Gertner, because so many women are “leaning out” of their professions — that is, anticipating future pressures and so choosing career paths that enable them to leave the workplace more readily. (She gave as an example the woman who chooses a small family-practice firm over a larger one that presents more challenges and opportunities.) “If women are leaning out” of their own volition, said Gertner, “then their failure to advance can’t be the subject of a lawsuit.”

Besides, she added, overt gender discrimination in the workplace has gone the way of discos and bell-bottoms, “a world that no longer exists.” What is left, said Gertner, is “implicit bias,” which has the same stalling effect on feminism as the maternal wall.

There is also an issue with executing the law itself — a denial of the power of context. The gender discrimination lawsuits that do make it to court are weakened by a tendency to “slice and dice” the circumstances of alleged discrimination, said Gertner. “You don’t look at them as a course of conduct,” but as separate events. “Discrimination in the real world does not fit into the legal models we have.”

One way to counteract this tendency in the law is to have judges on the bench who are aware of the way the world works. “I had an appreciation of context,” said Gertner of her time as a judge. “I never saw the law as legal rules on the page.” (That appreciation, in part, was biographical. Her judicial tenure was influenced by her early childhood in a tenement on Manhattan’s lower East Side, by championing unpopular clients as a young lawyer, and by becoming a mother at age 39.)

In the absence of overt gender discrimination, it is hard to get legal redress, said Gertner. For young women in the workplace today, “it’s the opacity of discrimination” that makes advancement difficult, she said, instead of the stark realities of discrimination in the 1970s. Gertner said, “It was easier for me.”

With feminism stalled by social pressures at home and the workplace, she offered a radical idea. “The government needs to step up to the plate,” Gertner said, beginning by providing incentives for day care that would make it easier for women to combine career and work.

After all, there is a “business case” to be made for gender equality in law firms and workplaces, “beyond the obvious need to tap a rich vein of talent,” said Gertner. In a diverse world, workplace diversity adds to “the texture and the richness of the dialogue,” she said.

In the end, feminism’s mission of workplace parity has been stalled by the three factors of the maternal wall, implicit bias, and the opacity of discrimination, Gertner said.

She said advocates have a list of things to do: parse workplace discrimination by collecting the right data; engage in collective action; and challenge the government to underwrite day care and other engines of cultural change.

But all this is not enough. “The most important thing is: We have to be unsatisfied,” Gertner told her largely female, professional audience. “We have to not believe that this was the accomplishment of the women’s movement — that I’m here and that you’re here is somehow all we can achieve.”

Ideology, Psychology, and Law – Introduction

Here’s a quick description.

Formally, the law is based solely on reasoned analysis, devoid of ideological biases or unconscious influences. Judges claim to act as umpires applying the rules, not making them. They frame their decisions as straightforward applications of an established set of legal doctrines, principles, and mandates to a given set of facts. As most legal scholars understand, however, the impression that the legal system projects is largely an illusion. As far back as 1881, Oliver Wendell Holmes, Jr. made a similar claim, writing that “the felt necessities of the time, the prevalent moral and political theories, intuitions of public policy, avowed or unconscious, even the prejudices which judges share with their fellow-men, have a good deal more to do than the syllogism in determining the rules by which men should be governed.”

More than a century later, we are now much closer to understanding the mechanisms responsible for the gap between the formal face of the law and the actual forces shaping it. Over the last decade or so, political scientists and legal academics have begun studying the linkages between ideologies, on one hand, and legal principles and policy outcomes on the other. During that same period, mind scientists have turned to understanding the psychological sources of ideology. This book is the first to bring many of the world’s experts on those topics together to examine the sometimes unsettling interactions between psychology, ideology, and law, and to better understand what, beyond and beneath the logic, animates the law.

This introductory chapter describes why this volume came together when it did and provides an overview of the general sections and the individual chapters and comments in the book. It begins with a brief, loose, and highly stylized history of the relationships between ideology, psychology, and law—a history premised on the oversimplifying assertion that something changed around the year 2000.

The Pretense of Colorblindness

In trying to prevent discrimination and prejudice, many companies adopt a strategy of “colorblindness”—actively trying to ignore racial differences when enacting policies and making organizational decisions. The logic is simple: if we don’t even notice race, then we can’t act in a racist manner.

The problem is that most of us naturally do notice each other’s racial differences, regardless of our employer’s policy.

“It’s so appealing on the surface to think that the best way to approach race is to pretend that it doesn’t exist,” says behavioral psychologist Michael I. Norton, an associate professor at Harvard Business School. “But research shows that it simply doesn’t work. We do notice race, and there’s no way of getting around this fact.”

Several studies by Norton and his colleagues show that attempting to overcome prejudice by ignoring race is an ineffective strategy that—in many cases—only serves to perpetuate bias. In short, bending over backward to ignore race can exacerbate rather than solve issues of race in the workplace.

“Umm, he has pants”

In efforts to be politically correct, people often avoid mentioning race when describing a person, even if that person’s race is the most obvious descriptor. (Comedian Stephen Colbert often pokes fun of this tendency on his TV show, The Colbert Report, claiming that he doesn’t “see color.”) If a manager, for example, is asked which guy Fred is, he or she may be loath to say, “Fred’s Asian,” even if Fred is the only Asian person in the company.

“Instead, it’s, ‘He’s that nice man who works in operations, and, umm, he has hair, and, umm, he has pants,’ ” Norton says. “And it keeps going on until finally someone comes out and asks, ‘Oh, is he Asian?’”

Norton and several colleagues documented this phenomenon in a study that they described in an article for the journal Psychological Science, Color Blindness and Interracial Interaction. The researchers conducted an experiment in which white participants engaged in a two-person guessing game designed—unbeknownst to them—to measure their tendencies toward attempted racial colorblindness.

Each participant was given a stack of photographs, which included 32 different faces. A partner sat across from the participant, looking at one picture that matched a picture from the participant’s stack. The participants were told that the goal of the game was to determine which photo the partner was holding by asking as few yes/no questions as possible—for example, “Is the person bald?”

Half the faces on the cards were black, and the other half white, so asking a yes/no question about skin color was a very efficient way to narrow down the identity of the photo on the partner’s card. But the researchers found that many of the participants completely avoided asking their partners about the skin color of the person in the photograph—especially when paired with a black partner. Some 93 percent of participants with white partners mentioned race during the guessing game, as opposed to just 64 percent who were playing the game with black partners.

Backfiring results

Two independent coders were hired to watch videos of the sessions on mute, rating the perceived friendliness of the white participants based on nonverbal cues. Alas, the participants who attempted colorblindness came across as especially unfriendly, often avoiding eye contact with their black partners. And when interviewed after the experiment, black partners reported perceiving the most racial bias among those participants who avoided mentioning race.

“The impression was that if you’re being so weird about not mentioning race, you probably have something to hide,” Norton says.

The researchers repeated the experiment on a group of elementary school children. The third graders often scored higher on the guessing game than grown-ups because, Norton says, they weren’t afraid to ask if the person in the photo was black or white. But many of the fourth and fifth graders avoided mentioning race during the game. As it turns out, racial colorblindness is a social convention that many Americans start to internalize by as young as age 10. “Very early on kids get the message that they are not supposed to acknowledge that they notice people’s race—often the result of a horrified reaction from a parent when they do,” Norton says.

A zero-sum game?

In addition to an ineffective strategy at managing interracial interactions, racial colorblindness has evolved into an argument against affirmative action policies, an issue Norton addresses in a recent working paper, Racial Colorblindness: Emergence, Practice, and Implications, cowritten with Evan P. Apfelbaum of MIT and Samuel R. Sommers of Tufts University.

“Though once emblematic of the fight for equal opportunity among racial minorities marginalized by openly discriminatory practices, contemporary legal arguments for colorblindness have become increasingly geared toward combating race-conscious policies,” they write. “If racial minority status confers an advantage in hiring and school admissions and in the selection of voting districts and government subcontractors—the argument goes—then Whites’ right for equal protection may be violated.”

In a related article, Whites See Racism as a Zero-Sum Game That They Are Now Losing, Norton and Sommers surveyed 100 white and 100 black respondents about their perceptions of racial bias in recent American history. They found that black respondents reported a large decrease in antiblack bias between the 1950s and the 2000s, but perceived virtually no antiwhite bias in that same period—ever. White respondents, on the other hand, perceived a large decrease in antiblack bias over time, but also a huge increase in antiwhite bias. In fact, on average, white respondents perceive more antiwhite bias than antiblack bias in the twenty-first century.

“It’s very hard to find a metric that suggests that white people actually have a worse time of it than black people,” Norton says. “But this perception is driving the current cultural discourse in race and affirmative action. It’s not just that whites think blacks are getting some unfair breaks, it’s that whites are thinking, ‘I’m actually the victim of discrimination now.’”

The Situation of Social Justice

This book review appeared earlier this week in the American Scientist:

THE FAIR SOCIETY: The Science of Human Nature and the Pursuit of Social Justice. Peter Corning. xiv + 237 pp. University of Chicago Press, 2011. $27.50.

After decades of exclusion from meaningful social and political discourse, themes of social justice are making a serious comeback. One can point to several recent examples from the disciplines of political science, economics and philosophy, including, respectively, Larry M. Bartels’s Unequal Democracy: The Political Economy of the New Gilded Age (Princeton University Press, 2008), Amartya Sen’s The Idea of Justice (Harvard University Press, 2009) and Derek Parfit’s massive two-volume tome On What Matters (Oxford University Press, 2011). These books have arrived to coincide with the apparent awakening of the sense of injustice in popular movements from Arab Spring to Occupy Wall Street.

Peter Corning, who was trained as a biologist and is now the director of the Institute for the Study of Complex Systems, joins the conversation at just the right time. His most recent book, The Fair Society, was published in early 2011, and—like Joseph Stiglitz’s Vanity Fair article “Of the 1%, by the 1%, for the 1%”—it has turned out to be remarkably prescient. Several chapters read like an annotated list of complaints made by the most well-informed campers in Zuccotti Park last fall. Corning notes, for example, that in the United States, “since the 1980s, some 94 percent of the total increase in personal income has gone to the top 1 percent of the population”; at least 25 million Americans (17.2 percent of the workforce) are presently struggling with unemployment or drastic underemployment; “close to 50 million Americans experienced ‘food deprivation’ (hunger) at various times in 2009”; and as many as 75 million Americans (25 percent of the population) live in poverty. Adding insult to injury, the top 10 percent of income earners in the United States live 4.5 years longer on average than the bottom 10 percent.

In a nutshell, Corning’s thesis is that human nature has evolved in such a way as to create a natural revulsion to states of affairs like these. In the opening chapters, he recounts various evolutionary arguments for the notion that our hunter-gatherer ancestors possessed a deep sense of fairness and developed “a pattern of egalitarian sharing” in which “dominance behaviors were actively resisted by coalitions of other group members.” He draws eclectically on studies of baboons, descriptive anthropological accounts of hunter-gatherer societies and, in a few cases, the fossil record. With this biological framework in place, Corning endeavors to show that the capitalist system as currently practiced in the United States and elsewhere is manifestly unfair. His beef is not solely with laissez-faire capitalism, however; he claims that socialism is just as unfair, although in different ways, and that efforts to develop a “third way” that avoids the excesses of capitalism and socialism have been “anemic” and “unable to confront the status quo” of class-based inequality. In place of these failed institutions, he proposes a new type of society founded on a biosocial contract, which he describes as a “truly voluntary bargain among various (empowered) stakeholders over how the benefits and obligations in a society are to be apportioned among the members” that is “grounded in our growing understanding of human nature and the basic purpose of a human society.” Such a contract, he writes, must be focused on fairness and the obligation to address the “shared survival and reproductive needs” of our species.

Corning draws most heavily on evolutionary biology, behavioral economics and anthropology, but experimental social psychology would also back him up—and quite a bit more directly. Indeed, some of his ideas seem to have been inspired by the work of Morton Deutsch, who suggested, in a well-known 1975 article in the Journal of Social Issues, that human beings are finely attuned to three major principles of justice: equity, equality and need. Corning offers a slightly modified list. He defines fairness in terms of equality (in the satisfaction of basic needs, not necessarily in outcomes), equity (or merit) and reciprocity. The core thesis of The Fair Society was also anticipated by Melvin Lerner, who argued in 1977 that a universal “justice motive” compels individuals to pursue fairness goals to rectify unfairness and—only if these routes are blocked—to engage in victim-blaming and other defensive strategies to maintain the desired belief that we live in a just world (even if we do not). Although Lerner was perhaps more sensitive than Corning to the perverse consequences of caring passionately about the appearance of justice (for instance, blaming victims of rape, poverty or illness for their misfortune so as not to give up cherished illusions about personal deservingness), the two writers share the assumption that justice concerns are an essential part of human nature.

Anyone who is capable of critical perspicacity with regard to capitalist economic systems and practices is obliged to agree with Corning’s observation that the massive upswing in economic inequality over the past 30 years is at odds with nearly every conception of justice since Plato and, in that sense, is difficult (if not impossible) to justify on normative philosophical grounds (although some conservative libertarians have tried). Let us also grant that humans are prepared to experience moral outrage in the face of unjustified inequality (or gross inequity). Even capuchin monkeys show “inequity aversion,” refusing to participate in games in which other monkeys are given greater rewards for equal effort, as Sarah F. Brosnan and Frans de Waal showed in a 2003 article in Nature. Corning connects such observations to the present socioeconomic situation, writing, “Defection is the likely response to an exploitative, asymmetrical interaction,” and “No wonder there were protests and even riots at WTO [World Trade Organization] meetings.”

There is only one problem, and it is one that has given social scientists fits: What took so long? Why have U.S. citizens, for instance, put up with starkly increasing inequality and the kind of economic policies that only a dyslexic Robin Hood could embrace? There is a joke, often attributed to economist Paul A. Samuelson, which goes, “Economists have correctly predicted nine of the last five recessions.” I would say that sociologists, political scientists and others who study protest movements suffer from a similar problem, to wit: “Social scientists have correctly predicted nine of the last five revolutions.” The great political theorist Ted Robert Gurr, for instance, wrote in 1970 that “Men are quick to aspire beyond their social means and quick to anger when those means prove inadequate, but slow to accept their limitations.” If this were true in a deep psychological sense, rebellion would be far more common than acquiescence, but this is simply not the case.

My own, admittedly incomplete answer to the social scientists’ conundrum has emphasized a human motivation that is frequently on a collision course with Lerner’s justice motive and Corning’s biosocial contract, namely, system-justification motivation: the (typically nonconscious) desire to defend, justify and rationalize existing systems, institutions and widespread practices, even if (from a more objective point of view) they violate standards of justice, including equity, equality and need. Corning grants that our sense of fairness can be “easily subverted,” quotes Dr. Pangloss’s rosy rationalizations in Voltaire’s satire Candide, and touches—but only lightly—on beliefs and ideologies that blunt the sense of injustice. To my mind, the problem of system justification in U.S. public opinion about economic inequality (especially among political conservatives) is addressed far more satisfactorily in chapter 5 of Bartels’s Unequal Democracy.

Despite this conspicuous omission, much of what Corning has written is both important and accurate. The Fair Society is wide ranging and covers many areas of scholarship in a useful, integrative, insightful manner. It is an edifying book—not least because it offers a tremendous collection of memorable quotations from justice scholars over the centuries—more than a groundbreaking one. One could reasonably wonder whether his proposed biosocial model, which draws heavily on aspects of stakeholder capitalism and closely resembles that of Swedish society, is really enough of an improvement over the socialist and capitalist systems he so effectively lambastes in earlier chapters of the book. Even if one accepts Corning’s goal, there are huge obstacles standing in the way of its implementation. He recognizes, quite correctly, that “conservatives with vested interests in the status quo will no doubt dismiss the idea of a Fair Society as just another utopian scheme,” but it is far from clear how proponents of social and economic justice will ever overcome conservative skepticism. “There must be a broad political consensus that social justice is a core social value,” he writes, but this is precisely the problem; such a consensus does not exist. “How do the roughly 70 percent of us who support the principle of fairness and social justice overcome the formidable power of the 30 percent who largely control our politics and our wealth and who will fiercely defend the existing system, and their self-interest?” he asks. How, indeed? The difficulty, in my view, is that no one, including Corning himself, offers a convincing answer to this question.

At this moment in history, when our problems are so much clearer than their solutions, it is a genuine contribution to offer clearheaded analysis and moral encouragement to take much-needed steps in the direction of social and economic justice. I admire Corning’s attempt to develop a normative theory of justice that is “built on an empirical foundation”—that is, knowledge gleaned from the social and behavioral sciences, including aggregate sociological data from research on social indicators. Along very similar lines, psychologist Aaron Kay and I have advocated “naturalizing” the study of social justice, thereby integrating descriptive and normative insights gleaned from psychology, social science, philosophy, law and other disciplines.

Given the thick walls that separate academic scholarship from popular concern and policy outcomes, it is probably too much to expect rapid implementation of the specific recommendations made in The Fair Society, such as these, which address taxation: “Eliminate property tax deductions for second (vacation) homes, tax capital gains at the same graduated rate as earned income, and eliminate the expanded home equity line of credit loan provisions.” Nevertheless, one hopes that those who wish to occupy places of power on behalf of the 99 percent will heed Corning’s sage advice about what to do and—just as important—what not to do in planning for a better, more just society.

The Imagined Ideological Divide

Republicans and Democrats are less divided in their attitudes than popularly believed, according to new research. It is exactly those perceptions of polarization, however, that help drive political engagement, researchers say.

“American polarization is largely exaggerated,” says Leaf Van Boven of the University of Colorado Boulder, especially by people who adopt strong political stances. And when people perceive a large gap between political parties, they may be more motivated to vote. That message emerges from analyses of 40 years’ worth of voter data and could help predict voting behavior for the 2012 presidential election, according to social psychologists presenting their work today at a conference in San Diego, CA.

Polarization and political engagement

Much of the data comes from the American National Election Studies, a large survey of American’s political attitudes and voting behaviors from 1948 to 2008 funded by the National Science Foundation (NSF), and from a nationally representative sample of American adults from 2008. Using a subset of 26,000 respondents from this data, John Chambers of the University of Florida and colleagues studied the degree to which people estimate differences between Republicans’ and Democrats’ attitudes. They found that the actual gap between the parties’ political attitudes has not increased substantially over time and that members of both parties have consistently overestimated the size of that gap.

Moreover, Chambers’ team found that those who perceived the greatest political polarization were more politically engaged – for example, more likely to have voted in the last election, tried to influence the vote of other voters, attended political rallies, or donated money to a party or candidate. “These findings may have important implications for election outcomes,” Chambers says. “Particularly in close or hotly-contested elections, the balance may be tipped in favor of the party whose members perceive more polarization between the two parties.”

Indeed, in the 2008 Presidential election, people who strongly supported either Obama or McCain perceived Americans as more polarized than did people whose support for either of the two candidates was more moderate, according to work by Van Boven of the University of Colorado Boulder. His NSF-funded study likewise found that people who perceived Americans as more polarized were more inclined to vote in the presidential election compared with people who perceived less polarization – independent how strongly they supported Obama or McCain.

Morality drives people to the polls

In another analysis from the 2008 election, moral conviction also significantly predicted the likelihood to vote, even when statistically controlling for people’s ideology, says G. Scott Morgan of Drew University. His research team surveyed 827 US residents about their political orientation, intentions to vote, and degrees of moral conviction on several issues, including abortion, same-sex marriage, tax cuts, and healthcare reform. They found that no party holds a monopoly on moral conviction.

The study counters the notion that conservatives’ political views and behaviors might be more greatly shaped by morality than those of liberals, Morgan says. Indeed, during the 2012 political campaign, he says “liberals and conservatives seem similarly likely to feel moral conviction about the issues that are important to them.”

Moral convictions change factual beliefs

Other researchers are investigating how people view morally controversial political issues. They are finding that people’s moral sensibilities shape their perceptions of facts.

Brittany Liu and Peter Ditto of the University of California, Irvine, tested how people’s perceptions of the costs and benefits of capital punishment changed when they read essays advocating either its inherent morality or immorality. The essays changed not only participants’ perceptions of the inherent morality of capital punishment but also beliefs about whether capital punishment deterred future crime or led to miscarriages of justice. “Changing participants’ moral beliefs led to corresponding changes in factual beliefs,” Liu says.

Related survey work found a similar pattern of results across many different issues, including forceful interrogations, stem cell research, abstinence-only sexual education, and global warming. The results help explain some of the major impediments to bipartisan cooperation, Liu says. “For both liberals and conservatives, there is no clean separation between moral intuitions and factual beliefs,” she says. “This affects how politicians and partisans interpret scientific and economic data, making compromise difficult as both sides hold drastically different beliefs about the relevant facts and data.”

Accept or Rebel?

The political unrest in the Middle East, which continues today in Syria, raises some intriguing questions: How can we explain the contagion effect of rebellion when revolution spreads from nation to nation? Is it possible to predict whether people will respond to limits on freedom with submission or rebellion?

New research from Duke University and the University of Waterloo to be published in the February edition of the journal Psychological Science finds the certainty of a restriction is significant in determining how people will respond to enforced limitations on freedom.

Across several studies, participants responded to restrictions that were certain to come into effect more favorably and valuing the restricted freedoms less, a form of “rationalization.” Participants responded to identical restrictions that were described as having a small chance of not coming into effect with “reactance,” viewing restrictions less favorably and valuing the restricted freedoms more.

“There have traditionally been two schools of thought on how people react to restrictions on freedoms,” said Gavan Fitzsimons, professor of marketing at Duke’s Fuqua School of Business and one of the study’s authors. “One school of thought says people are likely to react to restrictions with rationalization and a level of acceptance, while a second suggests people are motivated to restore restricted freedoms and will respond negatively on attempts to constrain them. Our research reconciles these two opposing views by considering the restrictions’ degree of absoluteness.”

The study cites several hypothetical situations to explain the varied responses to restrictions on freedom. In one survey, participants read that the government had decided to reduce speed limits after experts concluded lower speed limits in cities increase safety. Some participants were told the new limits would definitely come into effect (an absolute condition), while others were told the limits would come into effect only if a majority of government officials voted to enact it (a non-absolute condition).

Participants in the absolute group tended to rationalize the new restrictions; they reacted with more positive attitudes and lower levels of annoyance toward reduced speed limits. In contrast, participants in the non-absolute group reacted strongly against the limits.

“Our findings have a number of practical applications, potentially shedding some light on the recent string of uprisings in the Middle East,” said co-author Aaron Kay, an associate professor of management and of psychology and neuroscience at Duke.

“To the extent a political regime feels absolute and permanent to its citizens, people will rationalize its actions and decisions, even minimizing the importance of freedoms. But once they learn similar regimes have been toppled and are therefore not as permanent as people once thought, they may become reactant and perhaps motivated to revolt,” he said.
